OVERVIEW
This legal reform aims to improve female workers’ rights to maternity and childcare leave by increasing the number of days of maternity leave and the amount of paid leave, and by extending similar rights to employees’ spouses.
The Labor Protection Act (No. 9) B.E. 2568 (2025) is now officially announced in the Royal Gazette on November 7, 2025, and it will come into effect on 7 December 2025.
Summary of the Provision: 3 significant amendments have been introduced:
Sample Case: An employee of Co. A took maternity leave. Her husband worked for Co. B, a different company from Co. A.
Notes:
- The salary that is subject to calculation is a fixed amount paid monthly, regardless of the name.
- For maternity leave, the company is obligated to pay 60 days’ salary, the remaining period is usually covered by the Social Security Fund.
